Description of dispute resolution event
The training will include best practices on how to prepare to negotiate at the mediation table, in order to help ensure client objectives are achieved for the dispute at hand, because it can often deliver a faster and more practical outcome. The training will suggest approaches to structuring the process of ADR for maximum mutual benefit to the parties, with greater control over the process and outcomes. The training will include lectures, demonstrations, role playing by attendees, and mediation and negotiation skills that are fair and practical. Participants will be provided with course materials with tried and tested strategies and analysis about the use of negotiation as an alternative to formal steps of litigation to help them to find workable solutions and get the most out of the negotiation and mediation processes. Based on a realistic commercial dispute case study, the training is designed to help the new legal practitioner get started with a dispute in the commercial context by assessing the case alongside a lawyer, and the experienced legal practitioner to enhance skills and strategies. Mediation is a structured step in dispute resolution and may be preferable before formal proceedings in some matters. Attendees will leave the training better prepared to resolve their litigation matters successfully using mediation rather than relying only on proceedings in the court or in a court, within the local framework of the High Court of South Africa and the law, with timing and context relevant to a settlement in South Africa.

Presenter biographies
Sheldon J. Stark
Sheldon is a distinguished mediator, arbitrator, and legal educator with over five decades of experience in dispute resolution, including extensive work as a neutral practitioner. A Distinguished Fellow of the International Academy of Mediators and the National Academy of Distinguished Neutrals, Stark has delivered ICLE’s 40-hour hands-on mediation training continuously since 2001, with the course reflecting his commitment to structured, practical instruction, and taught at Harvard Law School for over two decades. He served as Chair of the State Bar of Michigan’s ADR Section and has been named a top ADR lawyer by dBusiness Magazine on multiple occasions. His published works specifically address negotiation strategy and mediation technique, making him an authoritative and compelling trainer for participants the course is designed to serve.
Adv. Doris Goodenough
Doris is an experienced Johannesburg advocate and accredited mediator whose career spans more than three decades of civil litigation and dispute resolution practice. She has presided several times as an Acting Judge, and has mediated commercial, family law, RAF, and personal injury disputes. She has sat on both sides of the mediation table — as a mediator and as legal representative, with extensive practical experience in mediation. Her July 2025 workshop prepared plaintiff’s representatives for RAF mediations and was well received by legal practitioners.
