Shoki Mphela is an Attorney of the High Court of South Africa with 12 years post-qualification experience and an accredited Commercial and Personal Injury Mediator since 2019. She has extensive experience in commercial law, corporate governance, complex litigation, and strategic dispute resolution. Her background includes senior legal leadership roles in both private practice and the public sector, advising corporate entities, boards, executives, entrepreneurs, and public institutions on commercial transactions, regulatory compliance, governance, and litigation strategy.
As a mediator, Shoki is known for a commercially informed, practical, and human-centred approach. She does not approach disputes from a purely legal perspective. She helps parties understand the commercial, organisational, and relational dynamics that influence decision-making, while staying focused on what is realistically workable. She is relationship- and business-focused, and brings calm clarity to complex disputes, with a strong ability to identify the real issues beneath the surface.
Shoki adapts her approach to the needs of the matter and the parties, drawing on evaluative, transformative, and narrative mediation styles. She is well placed to mediate medical malpractice and healthcare disputes, public liability matters, Road Accident Fund and personal injury claims, construction and mining-related professional negligence, commercial agreement and contractual disputes, and employment-related conflict. Her industry exposure includes mining, leasing agreements, sports-related commercial matters, and disputes involving organs of state and public institutions.
Her perspective is further strengthened by her public sector experience, including a two-year role at a parastatal with seven subsidiaries operating across diverse industries such as mining, agriculture, cybersecurity and IT solutions, and special economic zones. This breadth enables her to understand the realities faced by individuals, SMEs, executives, boards, government entities, and large corporate structures.
